Sunny Street (“we,” “our,” or “us”) is committed to ensuring that all communications comply with applicable laws, regulations, and best practices, including those related to SMS/MMS messaging. This Opt-In/Opt-Out Policy describes how users may consent to receive communications from us and how they can withdraw that consent at any time.

  

1. Purpose

This policy governs the collection of user consent for receiving SMS/MMS communications related to Sunny Street’s services, including event updates, bidding notifications, auction status updates, account verification, and customer support. It also outlines the process for opting out of such communications.

  

2. Opt-In Procedure

To receive SMS/MMS messages from Sunny Street, users must explicitly provide consent through one of the approved methods below. The consent process is transparent, unambiguous, and documented.

2.1 Approved Opt-In Methods

Users may opt in through:

  1. In-App Sign-Up / Check-In Flow

As shown in the provided screenshots, the opt-in process includes:

  • Step 1: Clicking “Check In” or “Sign Up” on the event page.
  • Step 2: Entering first name, last name, and email address for identity verification.
  • Step 3: Providing a U.S. phone number in the “Please enter your U.S. phone number” screen.
  • Step 4: Receiving a 6-digit verification code via SMS and entering it into the “Verify Phone Number” screen.
  • Step 5: Upon successful verification, being informed that “You have checked in as a guest!” or completing account creation.

Consent Language Displayed During Process:

By entering your phone number and completing verification, you agree to receive SMS messages from Sunny Street related to your account, event participation, and bidding activity. Message and data rates may apply. Message frequency varies. You may reply STOP to cancel at any time.

  1. Web Account Registration
    • During account sign-up on our website or app, users provide their phone number and check a box agreeing to receive SMS communications for account verification, event updates, and auction notifications.
    • The agreement references this Opt-In/Opt-Out Policy.

  1. Written or Verbal Consent
    • In certain event or customer service scenarios, consent may be collected verbally or via written forms that clearly state SMS consent terms.

      

3. Opt-Out Procedure

Users may opt out of receiving SMS/MMS messages at any time using one of the following methods:

  • Text STOP to any message received from Sunny Street.
    • After sending STOP, the user will receive one final confirmation message:

“You have successfully unsubscribed from Sunny Street SMS messages. You will no longer receive messages from us. Reply START to re-subscribe.”

  • In-App Settings:
    • Navigate to account settings in the Sunny Street app and toggle SMS notifications off.
  • Customer Support:
    • Contact our support team via email at contact@sunnystreet.com or call +18019954499 to request removal from our SMS list.

Opt-out requests are processed immediately, but please allow up to 24 hours for all systems to update.

  

4. Message Content & Frequency

  • Types of Messages: Account verification, event reminders, auction updates, bidding status changes, payment confirmations, and customer support communications.
  • Frequency: Varies by event participation and user activity; typically 1–10 messages per week.

  

5. Carrier & Message Disclaimers

  • Message and data rates may apply.
  • Mobile carriers are not liable for delayed or undelivered messages.
  • SMS delivery is subject to the user’s mobile carrier service availability.

  

6. Data Handling

All phone numbers and associated personal information collected during the opt-in process are handled in accordance with our [Privacy Policy] and [Terms of Use], including secure storage, restricted access, and non-disclosure except as required to provide services or by law.
